Hi, Is this Hershey's fault or the person eating the candy? Myself I eat the candy by choice and not being forced by the candy companys.

I understand that, but people have been aware of the issues with overconsumption of sugary stuff for years. I mean where does it end.
Take this scenario, different but similar, a patient needs an operation, they are told there are risks, they choose to go for the operation anyway, there are complications, the doctor is sued. The doctor thinks, I am not doing thias again, so declines to operate on anyone using the same procedure. Patients can't find a doctor to carry out their procedure anymore.
It's like cigarettes, I have every sympathy with people who started to smoke, I know it's hard to give up and it's addictive, but we ARE told they can cause all manner of disease, and NOW people are suing the cigarette companies for their illness. Now, if you have an ailment caused my smoking before the warnings came on, when the advertisers CLAIMED that smoking was healthy and a goodthing to do, then yes, they do have a point, but for those who have been smoking for less than ten or twenty years they were already warned of the dangers and the increased risk.
I can see the same thing coming with sweets and all manner of foods with this in mind.
Yes, I know sweet things can be addictive, I'm not denying this, Yes, something needs to be done, we do need reeducating, but suing people isn't the way, taking control of our lives and our decisions is the way, accepting responsibility where it is due and acting upon whatever the consequences are in a responsible way.

Or perhaps to put it in more logical terms.. if Hersheys or indeed any company such as this were to be held accountable for the health of a nation, surely it would be more beneficial for them to have to pay for independant advertising and reeducation and for finding provisions and alternative snacks and for making amendments to their confectionary which would directly benefit the health of others and not just those who have had adverse effects despite knowing the risks.
I've spent a lot of time on local council websites discussing health issues and what the governments and companies can do to improve the general health of people. Things can only change if the people with power shout loud enough and if the people actually want to hear and act upon the message given. :(

What about those who have just found out about a wheat intolerance do they sue the flour and bread industry.
I haven't heard yet of people with a peanut intollerance sueing peanut growers and those who combine it in their foods.
And what about those who have a lactose or mild intollerance - will they be sueing the cows next.
I can't believe it, its the legal system gone mad, haven't they anything better to do. For gods sake no one is forcing anyone to eat these things. I may be getting the wrong end of the stick here guys and girls, as I have not actually looked at the onion site you all seem to be mentioning. But if, this is about suing the manufacterers of fattening food when you become obese because of eating it, then according to New Scientist magazine, which published a report on this same issue some months ago, they may actually have a case to answer for. It seems that high fat, high sugar junk food, such as the infamous Big M etc, (I am sure you all know who I mean) does actually actually trigger a chemical response in the brain which causes the body to crave more of the same, regardless of how bad this it is for us. The food can therefore be classed as addictive. From what I understand there are several cases pending in the US against a number of these fast food companies. It will be interesting to see the outcome.

You may well be right, but the fact is, that people still choose to eat these sweets and chocolate bars - nobody holds a gun to their heads and forces them. Addictions can be beaten, but some people don't want to beat theirs. If Hershey's were to lose a huge lawsuit in favour of 'get-rich-quick' merchants, then they would have to lay off many staff members and contribute towards the slowdown in the global economy - 'global' because Hershey's buy their raw materials from abroad and if they are having to fork out for compensation claims, they aren't buying goods. Compensation claimants in situations like this (ciggies, sweets, chocolate and so on) never think of how their actions might affect others, they are 'all out for themselves.' I wonder if the litigants who are suing cigarette companies for lung damage, etc are going to compensate people who have been damaged by their passive smoking over the years? Where will it all end?

You have a valid point Songstress, which I would agree with. I was not saying that it is okay to sue these manufacturers, as of course we all have to take responsiblity to what we put into our bodies, and it is a well known fact these too many sweets do cause all manner of health problems.

I think the whole thing is rediculouse? I think this person should've sued the God for "creating" the Glutony!!! I am sad to see that a lot of Americans are obese for some reason and it's not just because eating candies... How about burgers and chips and aother junk food? What is it a fast food industry or just a way of living that makes Americans soo obese? Perhaps, it's a pressure to succeed in life that makes them so obese? Everyday problems? In any case I don't think the Candy company is to blame....
